There are no restrictions imposed by ODNR on how close you can build to an existing well. The Federal Pipeline & Hazardous Materials Safety Administration has issued “guidelines” that recommend a minimum 100’ setback from an active well.
However, the oil and gas lease may establish set-backs and proximity restrictions that may come into play. The well operator is required to maintain access to the wellhead and tank battery at all times. It is in your own best interest to contact the well owner and/or well operator before you begin any construction that may impact the well.

Maybe, but this should be avoided if at all possible. There are no restrictions by ODNR, however, there may be limitations imposed by local building codes. Because a plugged well can begin leaking, it is not a good idea to build over top of a plugged well.
ODNR requires a 100’ set back from any “inhabited private dwelling house” or any public building in urban areas. In non-urban areas this distance can be reduced if the landowner signs a waiver granting consent.
